USA K1 Fiance Visa

The K1 Fiancé Visa, also known as the "fiancé(e) visa," is a non-immigrant visa that allows the foreign fiancé(e) of a U.S. citizen to enter the United States for the purpose of getting married. Once married, the foreign spouse can apply for adjustment of status to become a lawful permanent resident.

Eligibility

To be eligible for the K1 Fiancé Visa from Pakistan, both the U.S. citizen petitioner and the foreign fiancé(e) must meet certain requirements:

  1. U.S. Citizen Petitioner:
    • Must be a U.S. citizen.
    • Intends to marry the foreign fiancé(e) within 90 days of their arrival in the United States.
    • Must meet the income requirements to demonstrate the ability to support the fiancé(e).
  2. Foreign Fiancé(e):
    • Intends to marry the U.S. citizen petitioner within 90 days of arrival in the United States.
    • Both parties must be legally free to marry (unmarried and any previous marriages must be legally terminated).

Application Process

  1. File Petition (I-129F):
    • The U.S. citizen petitioner files Form I-129F, Petition for Alien Fiancé(e), with the U.S. Citizenship and Immigration Services (USCIS).
  2. USCIS Processing:
    • USCIS reviews the petition and, if approved, forwards it to the National Visa Center (NVC).
  3. NVC Processing:
    • The NVC forwards the case to the U.S. Embassy or Consulate in Islamabad, Pakistan.
  4. Visa Application:
    • The foreign fiancé(e) completes the DS-160 visa application and pays the visa application fee.
  5. Medical Examination:
    • The foreign fiancé(e) undergoes a medical examination by an approved panel physician.
  6. Consular Interview:
    • Attend a consular interview at the U.S. Embassy or Consulate in Islamabad.
  7. Visa Issuance:
    • If approved, the K1 Fiancé Visa is issued, allowing the foreign fiancé(e) to travel to the United States.
  8. Marriage within 90 Days:
    • The couple must marry within 90 days of the foreign fiancé(e)'s arrival in the United States.



Documents

For U.S. Citizen Petitioner

  1. Proof of U.S. Citizenship:
    • Valid U.S. passport or a certified copy of the birth certificate.
  2. Evidence of Relationship:
    • Photographs, correspondence, or other evidence demonstrating a bona fide relationship with the fiancé(e).
  3. Proof of Intent to Marry:
    • A signed statement from both parties affirming the intention to marry within 90 days.
  4. Financial Documents:
    • Recent tax returns, W-2s, or pay stubs to demonstrate the petitioner's ability to financially support the fiancé(e).

For Foreign Fiancé(e) from Pakistan

  1. Passport:
    • A valid passport.
  2. Police Clearance Certificate:
    • Obtain a police clearance certificate from the relevant authorities in Pakistan.
  3. Medical Examination:
    • Undergo a medical examination by an approved panel physician.
  4. Proof of Relationship:
    • Any evidence of the relationship, such as photographs, letters, or other relevant documents.
  5. Evidence of Intent to Marry:
    • A signed statement expressing the intent to marry the U.S. citizen petitioner within 90 days of arrival.
